CUSTOMER PRIVACY PROTECTION

Welcome to Clear Marketing. We appreciate your time in reviewing the Policies, Terms, and Conditions listed below for Website Design and Marketing Services.

COMPENSATION

All services require advance payment. The Client Organization agrees to make full payment for “One-time Services” either through our website, online gateway, or by check at the time of signing any Agreement, to begin any service. For “Monthly Services,” the Client Organization agrees to pay via automatic credit card transactions. Invoices will cover monthly fees and any additional services purchased. Invoices will be issued, and automatic transactions processed on the Renewal Date. Clear Marketing reserves the right to charge a late-payment fee of 1.5% per month on overdue balances.

CANCELLATION POLICY

Agreements may be terminated by either party with or without cause, with thirty (30) days written notice. Services provided in advance will be charged upon early termination, with refunds issued according to the terms outlined below. Clear Marketing reserves the right to cancel any agreement for projects that remain inactive for more than 30 days, with or without notice.

REFUND POLICY

A 100% refund is available only if cancellation occurs within 3 days of signing the initial contract. All sales are final. Projects may be split into monthly payments as a courtesy, but once payment or a deposit is made, it is non-refundable.

Digital marketing packages, including SEO and Social Media, are non-refundable, but clients may cancel with a 30-day written notice. No refunds are offered for services already delivered, initiated, or for miscellaneous charges incurred by Clear Marketing. No refunds are available once an initial draft is provided, and there are no partial refunds for projects that are mid-way through a milestone phase.

There are no refunds or credits of any kind for SEO, PPC, Social Media Marketing (SMM), Email Marketing, or other third-party online marketing services, even if fees were paid in advance. Web design and development incur significant resource costs; therefore, once payment or a deposit is made, it is non-refundable. Payment for hosting is also non-refundable.

If a project remains inactive or abandoned for more than 30 days, no refunds will be offered for deposits or payments. All billing cycles for agreed services will continue until the Client Organization provides a written cancellation notice.

COMPLETION OF WORK

In cases where delays are caused by the Client Organization failing to supply necessary content, images, or other materials, Clear Marketing reserves the right to extend any agreed-upon deadlines by a reasonable amount. Projects left inactive for over 30 days may be canceled without notice.

CONTENT MATERIALS

The Client Organization must provide all necessary materials to complete the work, including but not limited to text, logos, images, videos, and other content. Clear Marketing is not responsible for any copyright violations arising from materials submitted by the Client Organization and reserves the right to refuse any copyrighted materials unless proper usage permissions are provided.

For all Copywriting Services, Clear Marketing will create content as outlined by the Client Organization in terms of pages, word count, keywords, and style. The Client Organization will receive an initial draft for approval, followed by two additional revisions to finalize the content.

Clear Marketing grants the Client Organization full rights to display, publish, sell, and reproduce the content in any form.

DOMAIN NAMES AND WEB HOSTING

Hosting and domain services are not included in the price of Website Design. The Client Organization is responsible for obtaining its domain and hosting, either through Clear Marketing or a third-party provider. Additional expenses, including domain registration and web hosting, are outlined below.

REVISIONS

We offer 3 major revisions to the design. Our development process is flexible, allowing certain changes to the original specifications. However, significant deviations from the approved design will be charged at $175.00 per hour.

PROJECT DELAYS, CLIENT LIABILITY, AND APPROVALS

Timeframes and estimates are dependent on full cooperation from the Client Organization, including providing finalized content and feedback. A designated point of contact must be available to expedite the feedback process.

If delays exceeding 3 days occur due to missing content, a 30-day waiting period may be imposed to reinstate the project.

Upon completion, the Client Organization will be notified and given the opportunity to review the work. Written notice of any issues must be provided within 7 days. Once the final revision is approved, the contract is considered complete, and website files, logins, and passwords will be delivered.

INTELLECTUAL PROPERTY RIGHTS

The Client Organization is responsible for obtaining all necessary permissions for any content, images, logos, trademarks, or other materials provided. Clear Marketing will not be held liable for any claims or legal actions arising from the materials provided by the Client Organization.

LICENSING

Once the website is published, Clear Marketing grants the Client Organization a license to use the website, related software, and content for the duration of the website’s life.

NON-DISCLOSURE

Clear Marketing (and any subcontractors) will not disclose proprietary information provided by the Client Organization and will maintain confidentiality.

ADDITIONAL EXPENSES

Any additional costs, including template purchases, third-party software, stock photos, fonts, domain registration, and web hosting, will be reimbursed to Clear Marketing by the Client Organization.
